INTRODUCTION

Welcome to Planchis.

It is important that you read this Agreement and these policies before creating an account. By using Placnhis Services, you agree to this Terms of Use Agreement (the “Terms” or “Agreement”), which also includes our Privacy Policy and Community Guidelines. If you do not agree to be bound by this Agreement, do not access or use our Services.

Planchis is a platform that allows users to book tables for group plans, with a maximum of 6 people per table. Our goal is to facilitate the creation of new connections in a safe and friendly social environment.

We may update these Terms from time to time, so regularly check this page for updates. The terms “we” and/or “us” refer to Planchis. Together, you and Planchis may be referred to as the “Parties” or individually as “Party.” Subject to applicable law, we reserve the right to modify, amend, or change the Terms at any time. Notice of material changes will be posted on this page with an updated date. In certain circumstances, we may notify you of a change in the Terms by email or other means; however, you are responsible for regularly checking this page for any changes. Your continued access or use of our Services constitutes your ongoing agreement to any changes, and as a result, you will be legally bound by the updated Terms. If you do not agree to a change in the Terms, you must stop accessing or using our Services immediately. We reserve the right to change the availability of features in our subscription plans.

2. ELIGIBILITY, RESPONSIBILITIES, AND CONTENT

This Section details what you can and cannot do when using our Services, as well as the rights you grant to Planchis. Under these terms, you are not authorized to create an account or use the Services unless all of the following conditions are met, and by using our Services, you warrant that:

  1. You are a natural person of at least 18 years of age.
  2. You are legally qualified to enter into a binding contract with Planchis.
  3. You are not prohibited by law from using our Services.
  4. You do not have more than one account on our Services.
  5. You have not been previously removed from our Services.

You also agree to:

  1. Comply with these Terms of Use.
  2. Abide by all applicable laws, including but not limited to privacy laws, intellectual property laws, anti-spam laws, and regulatory requirements.
  3. Review and adhere to the Community Guidelines.
  4. Use the latest version of the mobile application.

Under these terms, you agree not to:

  1. Falsify your identity, age, or affiliations with a person or entity.
  2. Use the Services in a way that harms, disrupts, or negatively affects the platform, servers, or other users.
  3. Use our Services for harmful or illegal purposes, including but not limited to money laundering or other financial crimes.
  4. Harass, stalk, intimidate, defame, harm, or engage in any other form of abuse that may cause psychological harm.
  5. Use another user’s account.
  6. Copy, modify, distribute, transmit, or create any derivative works from Our Content, or any copyrighted material, images, trademarks, or other intellectual property accessible through our Services without prior consent from Planchis.
  7. Imply or state that any statement you make is endorsed by Planchis.
  8. Use any robot, crawler, proxy, manual or automated device, method, or process to access, retrieve, “scrape,” or otherwise circumvent the structure or presentation of our Services.
  9. Encourage, promote, or agree to participate in any activity that violates these Terms.

Planchis prohibits uploading or sharing content that:

  1. Falsifies your identity, age, or affiliations with a person or entity.
  2. Is obscene, pornographic, violent, or contains nudity.
  3. Is abusive, threatening, discriminatory, or promotes racism, sexism, or hatred.
  4. Encourages or facilitates any illegal activity.
  5. Encourages or facilitates any activity that may harm any of our users, including but not limited to self-harm, eating disorders, or harassment.
  6. Is defamatory or false.
  7. Is related to commercial activities (including but not limited to promotions and advertising, solicitation of services, “sugar daddy or mommy” relationships, links to other websites, or using Our Services as a channel to promote a social profile to increase followers or likes).
  8. Involves or propagates spam.

Uploading or sharing content that violates these Terms may result in the immediate suspension or termination of your account.

You are responsible for the content you upload about yourself. Do not share anything you would not want others to see, that violates this Agreement, or that could expose you or us to legal liability.

The content included in your individual profile must be relevant to the intended use of our Services and must comply with the Community Guidelines.

Your individual profile will be visible to others in the country you are located in, so ensure you are comfortable sharing Your Content before making it visible. You also understand and agree that we may monitor or review your content and have the right to remove, edit, restrict, or block or prevent access to any of Your Content at any time at our sole discretion. Furthermore, you understand and agree that we are under no obligation to display or review Your Content.

4. PURCHASES AND AUTOMATICALLY RENEWING SUBSCRIPTIONS

If you purchase a subscription, it will automatically renew, and you will be charged until you cancel it.

Planchis may offer products and services available for purchase through Google Play, iTunes, or other external services authorized by Planchis (including “MercadoPago” and “PayPal”). Planchis may also offer products and services for purchase via credit card or other payment processors on the Website or within the App (“In-App Purchases”). If you cancel your subscription, you will continue to have access to the benefits of your subscription until the end of your subscription period, at which point it will expire. We may offer promotional rates, which may vary based on the region, subscription duration, or item type. If you do not cancel your subscription in time, it will renew at the full price indicated at the time of purchase without any additional action required from you, and you authorize us to charge your payment method for these amounts. We reserve the right, even without prior notice, to limit the availability or continuation of any product, feature, service, or discounts offered.

When you choose to pay for a subscription on Planchis using any of the available payment solutions (such as Google Play or iTunes), it will include an automatically renewing subscription, meaning your account will be periodically charged for the subscription until you cancel it (you will be charged the agreed price and time period when you subscribed). If you do not want your subscription to renew automatically or wish to change or cancel your subscription, you must log in to the platform you used for it (iTunes or Google Play) and follow the instructions they provide to manage or cancel your subscription, even if you have deleted your account with us or removed the App from your device.

If you initiate a chargeback or otherwise reverse a payment, Planchis may immediately cancel your account at its sole discretion, on the grounds that you have determined you no longer want a Planchis subscription.

4a. VIRTUAL ITEMS

Virtual items, such as Credits, are non-refundable once used while using our services on Planchis.

Virtual items represent a limited license right governed by this Agreement and, except as prohibited by applicable law, no title or ownership in or to virtual items is being transferred or assigned to you. This Agreement should not be interpreted as a sale of any rights to virtual items. Any balance of virtual items displayed in your account does not constitute a real-world balance nor reflect any stored value but rather represents a measurement of the extent of your license. Virtual items do not incur fees for non-use; however, the license granted to you in virtual items will terminate according to the terms of this Agreement. Planchis, in its sole discretion, reserves the right to charge fees for the right to access or use virtual items and/or may distribute virtual items with or without charge. Planchis may manage, regulate, control, modify, or eliminate virtual items at any time, including actions that may impact the perceived value or purchase price, if applicable, of any virtual item.

5. ACCOUNT TERMINATION

You may delete your account and all associated information at any time by logging into the App, going to “My Account” → “Settings,” scrolling to the bottom, and tapping “Delete Account,” then follow the instructions to complete the deletion process. Please note that you must manually cancel any subscription through the payment service you used (iTunes or Google Play) to avoid additional billing.

We reserves the right to investigate and, if applicable, suspend or terminate your account without refund if we believes you have violated these Terms, misused our Services, or acted inappropriately or illegally, either on or off our Services.

5a. ELIMINATION OF INACTIVE ACCOUNTS AND TRUTHFULNESS

To maintain an ecosystem free of fake profiles, we may delete accounts that show signs of being fake, such as using meme images, landscapes, or photos that don’t represent you, as well as clearly incorrect information. This process will be faster if you have never used our service (e.g., joining a table, matching with someone, purchasing credits, etc.).

Similarly, accounts that remain inactive for an extended period may be deleted due to inactivity.

6. DISCLAIMER

WE ASSUME NO RESPONSIBILITY FOR ANY CONTENT YOU OR ANOTHER USER OR THIRD PARTY POSTS, SENDS, RECEIVES, OR TAKES ACTION ON THROUGH OUR SERVICES. THEREFORE, ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF OUR SERVICES IS ACCESSED AT YOUR OWN DISCRETION AND RISK. WE ARE NOT RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER HARDWARE, COMPUTER SOFTWARE, OR OTHER EQUIPMENT OR TECHNOLOGY USED.

7. ADVERTISEMENTS AND THIRD-PARTY CONTENT

By using our services, you may see promotions from third parties under ad networks like Google Ads or Facebook Audience Network or both. Planchis is not responsible for your interactions with those products or services.

Our Services may contain advertisements and promotions offered by third parties and links to other websites or resources. Additionally, our Services may allow you to view an ad in exchange for Virtual Items; Planchis does not guarantee that you will always be eligible to view such ads or that any ads will be available. Planchis may also provide non-commercial links or references to third parties within its content. Planchis is not responsible for the availability (or lack of availability) of any external website or resource or their content.

8. ADDITIONAL AGREEMENTS

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Planchis, our affiliates, and their respective officers, directors, agents, and employees from and against any and all claims, demands, complaints, damages, losses, costs, liabilities, and expenses, including attorney’s fees, arising out of or related in any way to your access or use of our Services, Your Content, your conduct toward other users, or your breach of this Agreement.

You agree that your Planchis account is non-transferable and all your rights to your account and its content terminate upon your death, unless otherwise provided by law. Any rights and licenses granted herein may not be transferred or assigned by you, but may be assigned by us without restriction.
